GIFT CARD POLICY

Effective Date: 1-1-2025

This Gift Card Policy (“Policy”) applies to gift cards purchased from Remedy Massage Therapy P.C. d/b/a Remedy Wellness (“Remedy Wellness,” “Remedy,” “we,” “us,” or “our”). It covers gift cards (“Gift Cards”) purchased through our website, our booking platform, or another platform we designate. This Policy adds to (but does not replace) our Terms of Service and Privacy Policy. This Policy is governed by the laws of the State of New York.

Purchasing Gift Cards

You may purchase Gift Cards for yourself or for someone else. If you buy a Gift Card online, you may need to provide payment information and the names and email addresses of the purchaser and the recipient. Once payment is successful, the Gift Card is sent electronically to the recipient email address you provide at checkout.

By purchasing a Gift Card, you confirm that the total charge, payment information, and all purchaser and recipient names and email addresses are accurate. You are solely responsible for any errors in the information you provide. Remedy is not responsible for Gift Card delivery delays or failures caused by: (1) inaccurate information provided by the purchaser; (2) issues with a third-party platform or payment processor; or (3) circumstances beyond Remedy's reasonable control.

Redeeming Gift Cards

Gift Cards are issued only by Remedy. Remedy will only accept Gift Cards that were purchased through our studio, our website, our booking platform, or another platform we designate. Gift Cards are transferable, not tied to a specific therapist, and can only be used to pay for eligible Remedy Wellness services and goods.

Gift Cards have no cash value, except as required by applicable law. Gift Cards cannot be used to buy other Gift Cards and cannot be exchanged for cash, except as required by law. Buying or using a Gift Card does not guarantee that a specific appointment time, service, or therapist will be available.

Refunds, Expiration, and Fees

All Gift Card purchases are final and non-refundable. Gift Cards do not expire. Remedy does not charge dormancy, inactivity, maintenance, or service fees on Gift Cards unless those fees are expressly disclosed and permitted by law. Remedy Wellness will manage its Gift Card program in compliance with all applicable notice and disclosure requirements, refund and cash-back rules, and any unclaimed property or escheat (the legal requirement to turn over unclaimed funds to the government) requirements. Remedy reserves the right to update or change this Policy at any time. Any updated version takes effect when it is posted.

Use, Loss, and Misuse

Remedy is not responsible for and will not replace lost, stolen, deleted, forwarded, intercepted, or misused Gift Cards, except where required by law. If a Gift Card is sent to the wrong email address, we may try to verify the purchase and reissue any remaining unused balance. However, we are not required to do so if we cannot verify the purchaser, the recipient, the remaining balance, or the Gift Card’s use history. Gift Cards may not be resold, used for unauthorized commercial purposes, or obtained or used fraudulently. Remedy reserves the right to void, suspend, or refuse to honor any Gift Card that Remedy believes was obtained or used in violation of this Policy.

Booking Appointments with Gift Cards

Appointments booked with Gift Cards are subject to Remedy’s standard booking, cancellation, payment, no-show, and client conduct policies. If you cancel late or do not show up for an appointment booked with a Gift Card, you authorize Remedy to deduct any applicable fees from your Gift Card balance. Remedy may also charge another approved payment method you have on file. This is consistent with our Terms of Service and applicable law.

Price Changes and Balances

Gift Cards are dollar-value credits unless they were expressly sold for a specific service or package. If prices go up after you purchase a Gift Card, you can still apply the Gift Card toward the current price of eligible services. The recipient is responsible for paying any difference. Any remaining balance can be used for future eligible Remedy Wellness services or goods, subject to this Policy. In no event will Remedy's liability related to any Gift Card exceed the original purchase price of that Gift Card.

Privacy and Payment Processing

Gift Card purchases may be processed through third-party payment processors. These may include Mangomint, Stripe, or others as designated by Remedy from time to time. Remedy remains responsible for its Gift Card program even if a third-party platform or processor handles the purchase or delivery. We may collect the following information: purchaser and recipient names and email addresses, gift message content, transaction details, payment status, and Gift Card use history. We use this information to process the purchase; send the Gift Card and receipt; verify balances; provide customer support; prevent fraud; comply with legal obligations; and enforce this Policy.
