Terms of Service
Effective Date: 01-01-24
Last Updated: 01-01-26
These Terms of Service ("Terms of Service") apply to the Remedy Wellness website, online booking pages, intake forms, communications, and in-person services. These are offered by Remedy Massage Therapy, P.C. d/b/a Remedy Wellness ("Remedy Wellness," "Remedy," "we," "us," or "our").
Our contact information is on our website. This includes our business address, email address, and phone number. Our address is 107 W 82nd St., Suite 108, New York, NY 10024. You may also reach us by email at [INSERT EMAIL] or by phone at (917) 558-0228.
Remedy Wellness is a therapeutic massage practice based in New York City. We offer personalized, client-centered massage therapy services. Our licensed massage therapists are trained in medical, prenatal/postnatal, sports, medical massage, and other therapeutic massage methods.
By using our website, submitting forms, booking an appointment, purchasing services, communicating with us, or receiving services from Remedy Wellness, you agree to these Terms of Service.
1. What These Terms Cover
These Terms of Service explain:
• the rules that govern use of our website, appointment booking tools, and massage therapy services;
• our scheduling, payment, cancellation, and studio conduct rules;
• how we collect, use, share, store, and protect personal information, including Health and Intake Information (meaning health history, current symptoms and treatment goals, injury and surgery history, pregnancy or postpartum status, physician referrals or restrictions, diagnosis information you provide, contraindications and sensitivities, and session notes and treatment-related records); and
• the choices and rights available to clients and website visitors.
Remedy Wellness is a therapeutic massage practice, not a spa. Our policies are designed to support respectful communication, therapist safety, reliable scheduling, and continuity of care.
2. Our Services and Professional Relationship
Remedy Wellness provides therapeutic massage services. These services are meant to support comfort, function, recovery, stress relief, and overall well-being. Services may include medical massage, therapeutic massage, prenatal or postnatal massage, sports massage, recovery-focused massage, and related bodywork. All services are provided within the therapist's lawful scope of practice.
Personalized Care
Before every session, your therapist may speak with you to check in on how you are feeling. They may ask about specific areas you would like addressed or avoided. Communication is key. Your therapist wants you to have a great experience, so please share your preferences, pressure preferences, and any concerns openly.
Your therapist may also ask about:
• your current symptoms;
• relevant health history;
• injuries, surgeries, medications, pregnancy status, and contraindications;
• stress levels, physical limitations, and activity goals; and
• areas you would like addressed or avoided.
Each session is tailored to your reported needs and your therapist’s professional judgment. Many clients choose to work with the same therapist over time. However, Remedy Wellness does not guarantee therapist availability or any particular therapeutic outcome.
No Guarantee of Results
Massage therapy can be beneficial, but results vary by person and condition. In some cases, symptoms may get worse before they improve as underlying conditions come to the surface. We do not promise that massage therapy will:
• cure any medical condition;
• eliminate pain permanently;
• replace medical care, physical therapy, psychotherapy, or medication;
• be appropriate for every person or every stage of a condition; or
• produce identical results from session to session.
You are responsible for getting diagnosis and treatment recommendations from your physician or other licensed healthcare providers when appropriate.
3. Medical Disclaimer and Emergencies
Content on our website, emails, text messages, social media, blog posts, and printed materials is for general information only. It is not medical advice. You should not use it as a substitute for individualized medical evaluation or treatment.
If you think you are having a medical emergency, please contact a licensed medical provider, call 911, or go to emergency care right away.
4. Eligibility and Minors
You may use our website and book services only if you are at least 18 years old and legally able to enter into a binding agreement. If you are under 18, a parent or legal guardian must agree to these Terms and book services on your behalf.
Minors
Clients under 18 may receive services only as allowed by law and our current studio policies. Depending on the service requested, we may require any or all of the following:
• written consent from a parent or legal guardian;
• a completed intake form signed by the parent or legal guardian;
• parent or legal guardian presence at the first appointment and/or during the session; and
• therapist approval based on the nature of the service requested.
5. Booking Appointments
You may book appointments through our website, through Mangomint (our third-party online scheduling and payment platform), or another online scheduling system we choose (which we may change at any time without prior notice to you), by phone, by email, or through other approved channels.
When you book an appointment, you agree that:
• the appointment time is reserved specifically for you;
• you will provide complete and accurate booking and intake information;
• you will update us if your contact or health information changes;
• you authorize us to communicate with you about your appointment and care as described below; and
• you are financially responsible for the fees associated with the time you reserve.
We may require a valid credit or debit card on file through Mangomint or another approved payment method. This is used to hold appointments and enforce our cancellation policy.
6. Intake Forms and Health Information
To provide safe and appropriate care, we may require you to fill out intake, consent, and health history forms before your first appointment. We may also ask you to update them from time to time.
You agree to provide truthful, current, and complete information. This includes information about:
• injuries and chronic conditions;
• pregnancy or possible pregnancy;
• surgery history;
• recent medical treatments or cosmetic procedures;
• allergies or sensitivities;
• medications or supplements you are taking, or have recently taken, that may affect circulation, blood pressure, body temperature, sensation, bruising or bleeding, or pain response;
• physician restrictions;
• relevant diagnoses;
• recent illness or exposure concerns; and
• any condition that could affect whether massage is safe or appropriate.
If you do not share relevant information, it may affect treatment decisions. It may also result in us refusing or stopping your service. To the fullest extent permitted by law, Remedy Wellness is not responsible for any harmful effects that result from your failure to provide accurate and complete health information. This also applies if you fail to follow therapist recommendations or post-session guidance.
7. Session Expectations, Draping, and Scope of Practice
Massage therapy at Remedy Wellness is professional therapeutic bodywork. All sessions are provided in a lawful, respectful, and clinically appropriate manner.
During the Session
• Your therapist may adjust pressure, positioning, bolstering, session length, or treatment areas based on your condition and comfort.
• You are encouraged to communicate about pressure, discomfort, temperature, positioning, draping, and any concerns during the session.
• Only areas reasonably necessary for the session will be worked on.
• You will be fully draped with sheets and a light blanket while lying on the massage table. Our therapists are trained professionals. Only the area being actively worked on will be undraped at any time, consistent with professional standards and New York law.
• You may disrobe to your level of comfort.
After Your Session
• After your session, your therapist will typically meet you in the waiting area with water to support post-treatment hydration. Front desk staff will help you check out and schedule your next appointment.
Scope of Practice
Our therapists do not provide services outside their legal scope of practice. Unless expressly agreed and lawfully permitted, services do not include diagnosis, prescriptions, chiropractic adjustments, physical therapy, or psychotherapy. Services never include sexual services of any kind.
8. Specialized Services
We work with a wide range of clients. This includes pregnant and postpartum clients, athletes, clients recovering from injury, clients managing stress, and clients with chronic or complex conditions.
These services can involve extra precautions. You agree to share any applicable information at booking and before treatment, including:
• pregnancy or postpartum status;
• high-risk pregnancy conditions;
• recent procedures or physician restrictions;
• athletic events, acute injuries, or return-to-play concerns;
• cancer history, lymphedema risk, ports, radiation sites, or treatment timing; and
• chronic illness considerations affecting pressure tolerance, circulation, positioning, or fatigue.
We may ask for physician clearance (written approval from your doctor) where appropriate. Certain specialized services require you to consult your physician before booking. For example, if you have acute infections, serious circulatory problems, active cancer, lymphedema complications, or are currently pregnant, you should consult your physician before booking services such as Manual Lymphatic Drainage (“MLD”) or other advanced therapeutic methods. It is your responsibility to disclose all applicable conditions and obtain any required medical clearance before your appointment.
9. Independent Therapists
Remedy Wellness works with independent licensed massage therapists and other qualified professionals. Each therapist is responsible for practicing within their own training, credentials, and lawful scope. Independent therapists are independent contractors. They are not employees or agents of Remedy Wellness. To the fullest extent permitted by applicable law, Remedy Wellness is not responsible for the individual acts, omissions, or professional judgments of independent therapists.
Therapists may differ in style, pressure, communication approach, and treatment emphasis. Remedy Wellness does not guarantee that every therapist will be the right fit for every client. We encourage open communication so we can help guide scheduling appropriately.
10. Fees and Payment
Fees for services are listed on our website or are otherwise shared with you before booking.
By booking an appointment or purchasing services, you authorize Remedy Wellness and its third-party payment processors to charge the applicable fees. These fees may include:
• service charges;
• applicable taxes, if any;
• late cancellation fees;
• no-show fees;
• package or gift certificate charges;
• other amounts you expressly authorize.
Accepted Payment Methods
We accept approved payment methods made available at checkout, through our booking platform Mangomint, or through our other approved booking or payment platforms. This includes HSA/FSA (Health Savings Account/Flexible Spending Account) cards for eligible services.
Credit Card on File
You may be required to keep a valid card on file through Mangomint, or another approved payment processor, to reserve appointments. By doing so, you authorize Remedy Wellness and its payment processors to charge that card under these Terms. This includes charges for late cancellation and no-show fees.
Chargebacks and Payment Disputes
If you think a charge was made in error, please contact us right away using the contact information on our website. Charges may appear through Mangomint or our third-party payment processor, as applicable. Improper or repeated chargebacks, payment reversals, or refusal to pay valid fees may result in suspension of future booking privileges. You agree to reimburse Remedy Wellness for any fees, costs, chargeback penalties, or collection expenses that Remedy Wellness incurs as a result of improper chargebacks or payment disputes.
11. Cancellations, Rescheduling, and No-Shows
Our appointments reserve therapist time specifically for each client. This makes reliable scheduling essential.
24-Hour Notice Requirement
We require at least 16 hours' notice to cancel or reschedule an appointment without penalty.
Late Cancellations
If you cancel, move, shorten, or reschedule an appointment with less than 16 hours' notice, you may be charged a late cancellation fee. Because appointment times are reserved in advance and many sessions are provided by independent therapists who set aside time specifically for booked clients, late changes can leave reserved professional time unfilled. The amount of that fee is posted at the time of booking or otherwise communicated to you.
No-Shows
If you miss your appointment without notice, you will be charged the full session cost.
Same-Day Changes
Unless we expressly tell you otherwise, same day reschedules are treated as late cancellations.
Emergency Exceptions
We understand that true emergencies happen. In exceptional circumstances, Remedy Wellness may waive or reduce a fee in its sole discretion (meaning the decision is entirely ours). A waiver on one occasion does not require a waiver in future situations.
Rebooking After Missed Appointments
Repeated late cancellations, no-shows, disputed charges, or failure to follow scheduling policies may result in:
• loss of online booking privileges;
• requirement of prepayment;
• limited access to certain appointment times; or
• discharge from the practice as a client, where appropriate.
12. Late Arrivals
Please arrive on time for your session.
If you arrive late:
• your session may be shortened;
• your session will still end at the originally scheduled time when necessary to protect the next client’s appointment;
• you remain responsible for the full scheduled fee; and
• if arrival is too late to begin safely or meaningfully, the appointment may be treated as a late cancellation or no-show.
13. Refunds
Except as required by law or stated in a specific written policy, service fees are non-refundable. This applies once the reserved appointment time has started or has passed without timely cancellation under our cancellation policy.
If Remedy Wellness cancels an appointment and does not reschedule it within a reasonable time, you may choose either:
• a refund of any prepaid amount for that appointment; or
• a credit toward a future appointment.
Packages, memberships, gift certificates, workshops, or prepaid service offerings may have their own separate written terms.
14. Gratuities
Remedy Wellness provides therapeutic and medically oriented massage therapy, not spa-style services.
Our rates are set to reflect professional therapeutic care. Gratuities are optional and never required.
15. Packages, Gift Certificates, and Prepaid Services
If Remedy Wellness offers packages, gift certificates, series, prepaid plans, or promotional credits, the following terms apply unless a separate Gift Card Policy or other written policy is provided at the time of purchase, in which case that separate policy will control for the subject matter it addresses:
• packages and gift certificates are redeemable only for eligible Remedy Wellness services, subject to any separate Gift Card Policy terms provided at purchase;
• they are not redeemable for cash except where required by law or as otherwise stated in an applicable Gift Card Policy;
• they may be non-transferable or limited to the original purchaser or designated recipient, subject to any separate Gift Card Policy or other written terms provided at purchase;
• unused balances may expire only to the extent permitted by law or as stated in an applicable Gift Card Policy;
• promotional offers may have separate expiration dates or restrictions set out in the applicable offer terms or Gift Card Policy;
• partially used packages are non-refundable except as required by applicable law; and
• scheduled sessions booked from a package remain subject to our cancellation and no-show policy.
16. Insurance, HSA/FSA, and Medical Receipts
Remedy Wellness does not accept insurance directly and is not an in-network provider.
HSA/FSA
We accept HSA/FSA cards for eligible services. Upon request, we can provide medical receipts for clients who want to submit them to their insurance company for reimbursement. Coverage and reimbursement rules vary by plan. We recommend checking with your provider directly about eligibility and required documentation. You are responsible for confirming with your plan administrator whether a service is eligible and whether supporting documentation is required.
Medical Receipts
Upon request, we may provide a medical receipt or similar documentation for services you purchased. You may use this to seek reimbursement from your insurer, plan administrator, or tax advisor.
Any receipt we provide is furnished as a courtesy. It does not guarantee:
• that your insurer will reimburse you;
• that the service qualifies under your HSA/FSA plan;
• that a particular code, description, or diagnosis will be accepted; or
• that massage therapy is a covered benefit under your plan.
You are solely responsible for verifying your coverage, reimbursement rules, documentation requirements, and tax treatment.
17. Client Conduct and Professional Boundaries
We are committed to a respectful, safe environment for clients, therapists, and staff.
Studio Environment
To keep a peaceful and therapeutic atmosphere for all clients and staff, we kindly ask that clients arrange childcare for children and make other arrangements for pets before their visit. This allows our therapists to focus entirely on your care and maintain a calm, professional environment for everyone. Remedy Wellness reserves the right to decline or reschedule appointments to maintain our studio environment.
Prohibited Conduct
The following conduct may result in the immediate end of a session, refusal of future service, and other appropriate action:
• sexual comments, jokes, requests, gestures, or advances;
• any request for sexualized touch or services outside lawful therapeutic massage;
• harassment, intimidation, discrimination, or abusive language;
• threatening, violent, or unsafe behavior;
• appearing intoxicated or impaired to a degree that makes treatment inappropriate or unsafe;
• recording staff or sessions without permission;
• repeated disregard of studio rules or boundaries; or
• fraudulent charge disputes or deliberate misuse of booking policies.
If a session is ended because of client misconduct, the full fee will still be charged.
18. Therapist Safety and Refusal of Service
Remedy Wellness and its therapists reserve the right to decline, postpone, modify, or stop a session when, in our judgment:
• massage is contraindicated or medically inadvisable;
• the client has not provided necessary health information;
• the client appears ill, contagious, impaired, or unsafe;
• the requested work is outside the therapist’s training or scope;
• boundaries are not being respected; or
• the environment otherwise presents safety or operational concerns.
19. Communications: Email, Calls, and Text Messages
We may communicate with you by email, phone, and text message for operational purposes and, where permitted, for marketing purposes.
Appointment and Care-Related Communications
By providing your contact information, you consent to receive communications such as:
• appointment confirmations and reminders;
• booking updates;
• waitlist offers;
• intake form reminders;
• payment receipts;
• follow-up care or administrative messages; and
• service-related announcements.
Text Message Terms
If you opt in to SMS (Short Message Service, or text) messages from Remedy Wellness:
• message frequency may vary;
• message and data rates may apply;
• you can opt out at any time by replying STOP;
• you can request help by replying HELP or by contacting us using the information on our website; and
• wireless carriers are not responsible for delayed or undelivered messages.
Mobile Information Sharing
Mobile information collected for SMS communications will not be shared with third parties or affiliates for their marketing or promotional purposes.
Marketing Emails and Texts
You may opt out of marketing emails by using the unsubscribe link in the message. You may opt out of marketing texts by replying STOP. Opting out of marketing does not stop us from sending transactional or service-related messages.

You may not:
• use the site for fraudulent or misleading purposes;

Those terms may change without notice from us.
23. Disclaimer of Warranties
To the fullest extent permitted by law:
• our website, content, and online services are provided on an "as is" and "as available" basis;
• we make no warranty that the website will be uninterrupted, secure, error-free, or free of harmful components; and

24. Limitation of Liability
To the fullest extent permitted by law, Remedy Wellness and its owners, directors, officers, employees, contractors, therapists, agents, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages. This applies to damages arising out of or related to:
• use of or inability to use the website;
• scheduling errors, interruptions, or technical failures;
• third-party platform failures, changes, or discontinuation of services;
• dissatisfaction with subjective treatment results or outcomes of in-person services; or
• communications delays or delivery failures.
To the fullest extent permitted by law, our total liability for any claim arising out of or related to these Terms of Service, the website, or our services is limited. The maximum amount we will owe you is the total amount you actually paid to Remedy Wellness during the 12 months immediately before the event that gave rise to the claim. Nothing in this section excludes liability that cannot be excluded under applicable law.
25. Indemnification
You agree to indemnify, defend, and hold harmless (meaning protect from legal and financial harm) Remedy Wellness and its owners, staff, contractors, therapists, and service providers. This protection covers claims, losses, liabilities, damages, and expenses, including reasonable attorneys’ fees and costs of enforcement. It applies to claims arising out of or related to:
• your breach of these Terms of Service;
• your misuse of the website;
• your violation of law;
• inaccurate or incomplete information you provide; or
• your conduct toward our therapists, staff, or other clients.

27. Severability
If any part of these Terms of Service or the Privacy Policy is found to be unenforceable, the rest of each document will remain in full force and effect to the fullest extent permitted by law.
28. Entire Agreement
These Terms of Service and Privacy Policy make up the agreement between you and Remedy Wellness on the subject matter addressed here. They are read together with any booking confirmations, informed consent documents, intake forms, package terms, gift certificate terms, and any separate notices or written financial policy we provide.
